Welcome to The Tom Shepherd School of Watercolour, referred to in these Terms of Service as the “Site”, “we”, “us” or “our”.
Our products, services, tutorials and membership content are provided subject to the following terms and conditions. By visiting, using or purchasing from the Site, you agree to be bound by these Terms of Service.
By visiting and using the Site, you consent to receive communications from us by email.
You agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be made in writing.
We grant you a limited, revocable licence to access and make personal use of the Site as our customer or member.
You are not permitted to:
reproduce, duplicate, copy, sell or otherwise exploit the Site or any product image, product listing, product description, price, page layout, page design, trademark, logo or other content for any commercial purpose;
use a robot, spider, data mining tool, extraction tool or similar process to monitor, extract or copy Site content, except in the operation or use of standard internet search engines, hit counters or similar technology;
use any meta tags, search terms, key terms or similar items that contain the Site’s name or trademarks used on the Site;
engage in any activity that interferes with the Site or another user’s ability to use the Site;

Any use of the Site or Site content that is not expressly authorised in these Terms of Service is prohibited and may immediately terminate the licence granted to you.
This Site may contain links to other websites.
We accept no responsibility for any content displayed on any other website that may be linked to from this Site. Use of any external website is at the user’s own risk.
While using the Site, you are responsible for the security of your account details and password. You agree to accept responsibility for all activities that occur under your account and password.
We reserve the right to terminate accounts, remove or edit content, refuse service, or suspend or cancel subscriptions where we believe there has been a breach of these Terms of Service or improper use of the Site.
Tutorials are made available for the duration of your paid subscription being active. Subscription payments provide access to the content only and do not transfer ownership of any subscription content.
If your subscription is not renewed, your access to the paid tutorials will be suspended. Your access to free tutorials will remain available, subject to any free membership access provided on the Site.
If your subscription is later reactivated, your account access will be restored to its previous state, including access to any tutorials available under your subscription plan at that time.
By purchasing a subscription plan offered on the Site, you agree to the Site storing information such as the IP address used by your device to log into the subscription area. This information may be stored and monitored to help us assess appropriate use of subscription accounts and protect the security of the Site.
Subscription plans are intended for the exclusive personal use of the registered account holder and are non-transferable.
Any information stored and monitored will not be passed to third parties except as described in our Privacy Policy.
We urge all users to maintain backup versions of any materials submitted to us. You understand and agree that the provision of any materials to us through the Site is done at your own risk. You are solely responsible for any loss or damage to your content, image, computer system or data that may result from the download or upload of any material.
We are not responsible for any loss of data or files resulting from suspension or deletion of data or files, network or system outages, file corruption or any other reason. We are not required to return any materials you submit to the Site.
By purchasing a subscription plan offered on the Site, you authorise The Tom Shepherd School of Watercolour to send instructions to the financial institution that issued your card to take payments from your card account in accordance with the subscription plan you selected.
Notwithstanding any product prices shown on the Site, we cannot confirm the final price of an item or subscription until your order has been completed through the checkout process.
An automatic recurring transaction will be processed at the relevant renewal period and price as set out in your subscription plan, unless your subscription is cancelled or paused before the renewal payment is due.
You will receive a renewal reminder email before any automatic renewal payment is taken.
Information about how to cancel or pause your subscription, request a refund, or exercise any applicable withdrawal rights is set out in our separate Refunds, Cancellations and Pausing Your Membership Policy.
Gift vouchers are valid for a maximum of 12 months from the date of purchase unless otherwise stated.
Gift vouchers cannot be used in conjunction with any other offer. There are no cash alternatives.
In the case of promotional codes or special offers, we reserve the right to cancel or amend offers without prior written notice.
Unless otherwise stated, promotional discounts and codes applied to a membership are valid for the first 12 months of membership only.
For annual memberships, this means the discount will apply to one annual membership payment or renewal. For monthly memberships, this means the discount will apply to up to 12 monthly subscription payments.
After the first 12 months, subsequent renewal payments will be charged at the standard membership price unless the membership is cancelled or paused beforehand, or unless a continuing discount has been expressly agreed.
We operate a separate Refunds, Cancellations and Pausing Your Membership Policy, which explains:
how to cancel your subscription;
how to pause your membership;
what happens to your access when you cancel or pause;
how renewal payments work;
how to request a refund;
the 14-day refund period for subscription payments; and
any applicable withdrawal rights for customers in the European Union.

We attempt to describe the products, services and memberships offered on the Site as accurately as possible.
However, we do not warrant that product descriptions or other Site content are accurate, complete, reliable, current or error-free.
If a physical product offered by us and purchased by you is not as described, your remedy is to return it in unused condition for a refund or credit, subject to any applicable consumer rights.
By visiting the Site, you agree that the laws of the United Kingdom, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and us relating to these terms.
Any dispute relating in any way to your visit to or use of the Site shall be adjudicated in the appropriate courts of the United Kingdom, and you consent to the jurisdiction and venue of such courts, subject to any mandatory consumer rights that may apply in your country of residence.

All content included on the Site, including but not limited to images, text, graphics, logos, videos, tutorials, button icons and digital materials, is the property of Tom Shepherd School of Watercolour Ltd, or its content suppliers, and is protected by applicable copyright laws.
The purchase of any product, subscription or membership does not provide the purchaser with any copyright interest or other intellectual property right in the product, tutorial, video, image or other content.
All content on the Site that is not the property of Tom Shepherd School of Watercolour Ltd is used with permission.
The arrangement of all content on the Site is the exclusive property of Tom Shepherd School of Watercolour Ltd and is protected by applicable copyright laws.
All software used on the Site is the property of Tom Shepherd School of Watercolour Ltd or its software suppliers and is protected by applicable copyright laws.
